The following describes the terms in which MusicalAdvantage.com offers you access to our services.

This Agreement describes the terms and conditions applicable to a visitor's or member's use of our services available under the domain and sub-domains of:

You must read, agree with and accept all of the terms and conditions contained in this Terms of Use Agreement and the Privacy Policy before you may become a member of Musical Advantage or use our services.

It is important to understand that we offer a website for users (a.k.a. visitors) to find Music Teachers and Musicians, which are our members. We are not involved in the actual transaction between users and our members. As a result, we have no control over the quality, safety or legality of what is listed or promised by our members, or the truth or accuracy of member profiles. Therefore musicaladvantage.com is not responsible for any legal matters arising from errors or misinformation that may be included in the profiles of our members.

Limitation of Liability

IN NO EVENT, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL MUSICAL ADVANTAGE BE LIABLE IN CONTRACT, TORT, STRICT LIABILITY, WARRANTY OR OTHERWISE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DELAY, DISRUPTION, LOSS OF PRODUCT, LOSS OF PROFIT OR REVENUE, OR LOSS OF USE OF EQUIPMENT OR SYSTEM, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE INFORMATION ON THIS SITE, EVEN IF MUSICAL ADVANTAGE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to NOT hold us responsible for any injury, claim, or fees made by you or any third party due to your breach of this agreement.

Members agree to the following:

1.) Musicaladvantage.com reserves the right to refuse membership and/or cancel subscriptions at its discretion, including if musicaladvantage.com believes the member's conduct violates applicable law or is detrimental to the interests of musicaladvantage.com.
2.) Member profiles will solely contain information about the member and their musical related education, bibliography, and experiences.
3.) Musicaladvantage.com reserves the right to modify member profiles to meet the terms of this agreement.
4.) Membership fees are not refundable after the 30 day guarantee period.
5.) Membership fees are paid monthly or annually for subscription based registrations via our merchant processing service, PayPal. For non-subscription memberships, members are emailed renewal notices prior to the expiration of their membership.
6.) Members agree to receive our Quarterly Newsletter, which validates their email address, provides important membership information, and informs our members about special offers and discounts. Member email addresses are for internal use only and are NEVER sold or provided to outside agencies or companies. Refer to our complete Privacy Policy for more information.
7.) Membership fees are subject to change.

Members and users will NOT:

1.) Use musicaladvantage.com for spamming purposes.
2.) Submit, list, or upload any material which is offensive, or viewed to be abusive, indecent, or obscene, or in breach of any copyright or privacy agreement.
3.) Submit, list or upload misleading or false information.

This Terms of Use Agreement applies to all users effective September 30, 2006.
